These Terms of Use, Booking and Payment (the “Terms”) govern access to and use of the Humanivia.ca website (the “Site”), as well as the services, content, tools, features, forms, bookings, payments, and communications offered by Humanivia.
By accessing the Site, browsing it, using its features, submitting a form, booking a service, or making a payment, you agree to be bound by these Terms. If you do not accept these Terms, you must immediately stop using the Site.
1. COMPANY IDENTIFICATION
The Site is operated by Humanivia, a company offering, among other things, support, guidance, coordination, matching, preliminary assessment, orientation, and follow-up services for families, children, parents and, where applicable, professionals or service providers associated with its network.

2. PURPOSE OF THE SITE
The purpose of the Site is to:
- present Humanivia's services;
- allow users to obtain information;
- allow users to contact Humanivia;
- allow users to book services or consultations;
- allow certain online payments;
- facilitate matching, administrative follow-up, and certain service-related communications.
The Site and its content are provided for informational and administrative purposes only. Unless expressly stated otherwise in a written agreement, the content published on the Site does not constitute legal, medical, psychiatric, psychological, tax, or any other regulated professional advice.
3. ELIGIBILITY AND USE OF THE SITE
By using the Site, you represent that you:
- have the legal capacity to accept these Terms;
- will provide accurate, complete, and up-to-date information;
- will use the Site only for lawful and legitimate purposes;
- will not use the Site in a way that harms Humanivia, its users, partners, or service providers.
If you use the Site or book a service on behalf of a child, minor, or another person, you represent that you are authorized to act on that person's behalf.
4.GENERAL DESCRIPTION OF THE SERVICES
Humanivia may offer, depending on availability and the evolution of its activities:
- educational or family support;
- specialized support;
- consultation or follow-up meetings;
- observation, orientation, and general recommendations;
- service coordination;
- matching with an independent provider or practitioner;
- one-time, package-based, or recurring services.
Humanivia reserves the right to modify, remove, suspend, or evolve its services at any time and without notice, subject to commitments already confirmed with clients.
5. INDEPENDENT SERVICE PROVIDERS AND HUMANIVIA'S ROLE
Certain services offered through Humanivia may be provided by independent service providers, self-employed workers, or external collaborators who are part of the Humanivia network.
Unless expressly stated otherwise, these providers act as independent contractors and not as employees of the client.
Humanivia may act, among other things, to:
- present services;
- organize bookings;
- coordinate matching;
- provide certain administrative follow-ups;
- collect certain payments;
- oversee certain service standards.
However, the specific professional relationship, intervention methods, actual performance of the mandate, and certain obligations related to service delivery may rest directly with the provider concerned, depending on the nature of the selected service.
6. NO GUARANTEE OF RESULTS
Humanivia s'engage à fournir ses services avec sérieux, diligence et professionnalisme. Toutefois, aucun résultat précis n'est garanti.
Without limiting the generality of the foregoing, Humanivia does not guarantee:
- a specific or measurable improvement within a determined time frame;
- a particular academic outcome;
- admission into a program or institution;
- achievement of a specific objective;
- perfect compatibility between a client and a provider;
- the continued availability of the same provider.
Results depend in particular on the client's specific situation, the parties' cooperation, the quality of the information provided, the frequency of follow-ups, the family context, and external factors beyond Humanivia's control.
7. BOOKING OF SERVICES
Any booking made through the Site is subject to the availability of services, time slots, and, where applicable, service providers.
Humanivia reserves the right to:
- refuse a booking request;
- cancel or reschedule a booking in the event of unavailability;
- request additional information before confirming a service;
- modify the assignment of a provider;
- suspend access to a service if the conditions of collaboration are not respected.
A booking is considered confirmed only once a confirmation has been sent by Humanivia or by the technology platform used for that purpose.
8. ACCURACY OF INFORMATION PROVIDED BY THE CLIENT
The client agrees to provide truthful, complete, and up-to-date information in connection with any request, registration, booking, or communication.
Humanivia shall not be held liable for any delay, error, refusal of service, poor matching, or administrative issue resulting from inaccurate, incomplete, or outdated information.
9. PRICES
All prices displayed on the Site are in Canadian dollars (CAD) unless otherwise stated. Applicable taxes, where required, may be added at the time of payment.
Humanivia reserves the right to change its prices at any time. However, the price applicable to a confirmed booking remains the one displayed at the time of the transaction, except in the case of an obvious error, technical issue, or necessary correction.
10. PAIEMENT
Depending on the selected service, payment may be required:
- in full at the time of booking;
- as a deposit;
- according to an agreed payment schedule;
- by package;
- by invoice.
By making a payment, you represent that you are authorized to use the payment method provided and you authorize Humanivia, or its third-party payment provider, to collect the amounts due.
The client remains responsible for any unpaid, declined, chargebacked, or unjustifiably disputed amount.
Humanivia reserves the right to suspend or refuse any service until outstanding amounts have been paid.
11. CANCELLATION, RESCHEDULING, AND NO-SHOW POLICY
Unless otherwise expressly stated in a particular offer or specific agreement, the following policy applies:
- any cancellation made more than 48 hours before the scheduled appointment time may result, as applicable, in a rescheduling, credit, or refund;
- any cancellation made 48 hours or less before the appointment may result in the full or partial charge of the reserved service;
- any no-show without prior notice may be considered a missed appointment and may be non-refundable;
- any significant delay may shorten the duration of the appointment without any price reduction;
- Humanivia may, at its reasonable discretion, grant an accommodation in exceptional circumstances.
Where a refund is approved, it will be processed using the original payment method within a reasonable time.
12. RESCHEDULING OR CANCELLATION BY HUMANIVIA
Humanivia reserves the right to reschedule or cancel an appointment or service, including in the event of:
- a provider's unavailability;
- health issues or emergencies;
- operational constraints;
- force majeure;
- inappropriate client behavior;
- insufficient information to adequately provide the service.
Where Humanivia cancels an appointment without fault on the part of the client, a rescheduling, credit, or refund may be offered, depending on the circumstances.
13. SERVICES NOT INTENDED FOR EMERGENCIES
Humanivia's services do not constitute an emergency service.
The Site must not be used to report an urgent or critical situation. In the event of a medical, psychological, psychiatric, or immediate safety emergency, the appropriate emergency services must be contacted without delay.
14. EXPECTED CONDUCT
The client or user agrees at all times to behave respectfully, reasonably, and safely toward Humanivia, its representatives, providers, collaborators, and any other user of the Site.
Humanivia reserves the right to suspend or terminate a service relationship, without refund where appropriate, in the event of:
- abusive, defamatory, threatening, or discriminatory statements;
- harassment;
- serious breach of these Terms;
- fraudulent use of the Site;
- attempts to compromise the security of the Site or its systems;
- behavior compromising the safety or integrity of any person.
15. INTELLECTUAL PROPERTY
L'ensemble du contenu du Site, incluant notamment les textes, visuels, logos, documents, éléments graphiques, images, vidéos, icônes, marques, concepts, slogans, interfaces, téléchargements et structure générale, est protégé par les lois applicables en matière de propriété intellectuelle.
Unless Humanivia has provided prior written authorization, it is prohibited to:
- reproduce;
- copy;
- modify;
- distribute;
- republish;
- broadcast;
- commercially exploit;
all or any part of the Site's content.
16. PROHIBITED USE OF THE SITE
It is strictly prohibited to use the Site to:
- commit an illegal or fraudulent act;
- transmit false, misleading, or harmful content;
- infringe Humanivia's rights or the rights of third parties;
- introduce viruses, malicious scripts, or any other harmful element;
- attempt unauthorized access to systems, databases, or technical infrastructure;
- disrupt the normal functioning of the Site.
Humanivia may take any reasonable steps to prevent or stop such use.
17. EXTERNAL LINKS AND THIRD-PARTY SERVICES
The Site may contain links to or provide access to third-party tools, software, or platforms, including for:
- booking;
- payment;
- videoconferencing;
- calendar management;
- communications.
Humanivia is not responsible for the content, policies, terms, operation, or security of such third-party services. Their use is governed by the terms and policies of those providers.
18. SITE AVAILABILITY
Humanivia does not guarantee that the Site will be accessible continuously, without interruption, without error, or without harmful components.
Humanivia may interrupt, suspend, restrict, or modify access to the Site, in whole or in part, including for maintenance, updates, security, technical corrections, or the evolution of its services.
19. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Humanivia shall not be liable for any direct or indirect damage, including any loss of data, loss of revenue, loss of opportunity, delay, interruption, moral prejudice, or inconvenience resulting from:
- the use of or inability to use the Site;
- a technological failure;
- a display error;
- a delay or cancellation;
- an issue involving a third-party provider;
- an act or omission of an independent service provider;
- inaccurate information provided by the client;
- an event beyond Humanivia's reasonable control.
Nothing in these Terms shall be interpreted as excluding any right that cannot be excluded under applicable consumer protection laws.
20. INDEMNIFICATION
You agree to indemnify and hold harmless Humanivia, its directors, officers, employees, collaborators, representatives, and service providers from and against any claim, loss, liability, damage, cost, or expense, including reasonable legal fees, arising from:
- your use of the Site;
- your breach of these Terms;
- inaccurate information you provide;
- your fault, negligence, or misconduct;
- any infringement of a third party's rights.
21. ELECTRONIC COMMUNICATIONS
By submitting a request, booking a service, or communicating with Humanivia, you agree to receive electronic communications relating to your file, including to:
- confirm a booking;
- send reminders;
- request information;
- provide administrative follow-up;
- send invoices or receipts;
- communicate regarding a requested service.
Promotional communications, where applicable, will be sent in accordance with applicable laws, and you may withdraw your consent where permitted.
22.MINORS AND PARENTAL CONSENT
Where services concern a child or minor, the parent, tutor, or legal representative retaining the services declares that they:
- have the authority required to consent;
- provide accurate information;
- act in the best interests of the child;
- authorize Humanivia and, where applicable, the relevant providers to use the information necessary to provide the service.
Humanivia reserves the right to require any additional confirmation or authorization it deems necessary.
23. FORCE MAJEURE
Humanivia shall not be held liable for any delay, cancellation, suspension, or failure to perform resulting from an event beyond its reasonable control, including:
- major technological failure;
- Internet or power outage;
- illness;
- natural disaster;
- labour dispute;
- government decision;
- public health emergency;
- any event recognized as force majeure under applicable law.
24. SEVERABILITY
If any provision of these Terms is declared invalid, illegal, or unenforceable, that provision shall be interpreted in a manner that best preserves its original intent, without affecting the validity of the remaining provisions.
25. AMENDMENTS TO THE TERMS
Humanivia reserves the right to amend these Terms at any time.
The applicable version is the one posted on the Site on the date of the relevant use or booking, unless a different version has been expressly communicated to you for a specific service.
Continued use of the Site after amended Terms are posted constitutes acceptance of those amendments.
26. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Province of Québec and the laws of Canada applicable therein.
Any dispute arising from these Terms or the use of the Site shall be submitted to the competent courts of Québec, subject to any mandatory rights applicable to consumers.
